Terms and Conditions<\/strong><\/p>

1. Scope<\/p>

1.1. These Terms and Conditions apply to contracts for the rental of vacation apartments for lodging purposes, as well as to all other services provided to the guest in this context. The term \u201cAccommodation Agreement\u201d encompasses and replaces the following terms: lodging agreement, guest accommodation agreement, and vacation apartment agreement. <\/p>

1.2. Subletting or subleasing the vacation rental, as well as using it for purposes other than lodging, requires prior express consent in writing, whereby \u00a7 540(1), second sentence, of the German Civil Code (BGB) is waived, provided that the guest is not a consumer within the meaning of \u00a7 13 BGB.<\/p>

1.3. The guest’s general terms and conditions apply only if this has been expressly agreed upon in advance.<\/p>

1.4. The guest is not permitted to accommodate more people or pets on the premises than specified in the currently valid price list. In the event of a violation of this provision, BLT FeWo GmbH is entitled to terminate the contract without notice and to charge an additional fee for over-occupancy for the duration of the use in violation of the contract. <\/p>

2. Conclusion of the Contract, Contracting Parties, Statute of Limitations\u2028 \u2028<\/p>

2.1. The contracting parties are BLT FeWo GmbH and the guest. A contract is formed upon receipt of a booking request (in writing, online, by phone, or in person) from the guest or customer, followed by a corresponding booking confirmation from BLT FeWo GmbH. <\/p>

2.2. If a third party makes the reservation on behalf of the guest, any lack of authority to act on the guest\u2019s behalf shall be deemed approved unless a written revocation is received within one week of receipt of the reservation confirmation.<\/p>

2.3. All claims against BLT FeWo GmbH generally become time-barred one year after the statutory limitation period begins. This does not apply to claims for damages or other claims, provided that the latter are based on a breach of duty by BLT FeWo GmbH committed with intent or gross negligence. <\/p>

3. Services, Prices, Payment, Setoff<\/p>

3.1. BLT FeWo GmbH is obligated to make the vacation rental booked by the guest available and to provide the agreed-upon services.<\/p>

3.2. The guest is obligated to pay BLT FeWo GmbH the agreed-upon or applicable rates for the rental of the vacation apartment and any additional services the guest has used. This also applies to services ordered by the guest directly or through BLT FeWo GmbH that are provided by third parties and paid for in advance by BLT FeWo GmbH. <\/p>

3.3. The agreed-upon prices include the taxes and local fees in effect at the time the contract is concluded. They do not include local fees that the guest is personally liable to pay under the applicable local laws, such as a visitor\u2019s tax. In the event of a change in the statutory value-added tax or the introduction, modification, or abolition of local taxes or fees applicable to the subject matter of the contract after the contract is concluded, the prices will be adjusted accordingly. If the period between the conclusion of the contract and the guest\u2019s arrival exceeds 4 months and the statutory sales tax or any applicable local taxes and fees increase after the contract is concluded, BLT FeWo GmbH reserves the right to increase the agreed-upon prices by the amount by which the applicable sales tax or local taxes and fees have increased. <\/p>

3.4. BLT FeWo GmbH may make its approval of a guest\u2019s request to reduce the number of booked vacation rentals after the booking has been made, the services provided by BLT FeWo GmbH, or the guest\u2019s length of stay, subject to an increase in the price of the vacation rentals and\/or the other services provided by BLT FeWo GmbH.<\/p>

3.5. Invoices from BLT FeWo GmbH that do not specify a due date are payable in full immediately upon receipt. In the event of late payment by the guest, the statutory provisions shall apply. BLT FeWo GmbH reserves the right to prove that it has incurred greater damages. <\/p>

3.6. BLT FeWo GmbH is entitled to require the guest to make a reasonable advance payment or provide security, such as a credit card guarantee, upon conclusion of the contract. The amount of the advance payment and the payment dates may be agreed upon in writing in the contract. The statutory provisions remain unaffected with regard to advance payments or security deposits for package tours. <\/p>

3.7. BLT FeWo GmbH is also entitled to require the guest, at the beginning of and during the stay, to make a reasonable advance payment or provide security in accordance with Section 3.6 above for existing and future claims arising from the contract, provided that such payment has not already been made in accordance with Section 3.6 above.<\/p>

4. Guest\u2019s Withdrawal (Cancellation) \/ Failure to Use the Services of BLT FeWo GmbH (No-Show)\u2028 \u2028<\/p>

4.1. The customer may cancel the contract concluded with BLT FeWo GmbH only if a right of cancellation has been expressly agreed upon in the contract, if another statutory right of cancellation exists, or if BLT FeWo GmbH expressly consents to the cancellation of the contract. Both the agreement of a right of withdrawal and any consent to the termination of the contract must be made in writing. <\/p>

4.2. Cancellations will only be accepted in writing and require confirmation from BLT FeWo GmbH. Unless otherwise agreed, the following cancellation fees apply to changes or cancellations of reserved vacation rentals and will be billed:\u2028a. Up to 30 days before arrival: free of charge\u2028b. 29 to 0 days before arrival: 80% of the booked services\u2028c. If the service is canceled after use has begun (e.g., in the event of early departure), the portion of the service that has been used will be charged at 100% of the rate, and the portion of the service not used will be charged as a cancellation fee at 80% of the rate. <\/p>

4.3. BLT FeWo GmbH must take into account any income from renting the vacation rental to other parties. If the vacation rental is not rented to other parties, BLT FeWo GmbH may apply a flat-rate deduction for saved expenses. The guest is free to provide evidence that the aforementioned claim did not arise or did not arise in the amount claimed. <\/p>

4.4. The rental\/travel price does not include trip cancellation insurance. We recommend that you purchase trip cancellation insurance. <\/p>

5. Withdrawal by BLT FeWo GmbH<\/p>

5.1. If it has been contractually agreed that the guest may withdraw from the contract free of charge within a certain period, BLT FeWo GmbH is, for its part, entitled to withdraw from the contract during this period if there are inquiries from other guests regarding the apartment booked under the contract and the guest, upon inquiry by BLT FeWo GmbH and after being given a reasonable deadline, does not waive their right to withdraw.<\/p>

5.2. If an advance payment or security deposit agreed upon or required pursuant to Section 3.6 and\/or Section 3.7 is not made even after the expiration of a reasonable grace period set by BLT FeWo GmbH, BLT FeWo GmbH shall also be entitled to withdraw from the contract.<\/p>

5.3. Furthermore, BLT FeWo GmbH is entitled to terminate the contract for cause, in particular if\u2028\u2013 force majeure or other circumstances beyond BLT FeWo GmbH\u2019s control make it impossible to fulfill the contract;\u2028\u2013 the vacation rental or rooms are booked through culpable provision of misleading or false information or the concealment of material facts; such material facts may include the guest\u2019s identity, financial solvency, or the purpose of the stay;\u2028\u2013 BLT FeWo GmbH has reasonable grounds to believe that the use of the service may jeopardize the smooth operation of its business, its security, or its public reputation, provided that this is not attributable to the control or organizational sphere of BLT FeWo GmbH;\u2028\u2013 the purpose or reason for the stay is unlawful;\u2028\u2013 there is a violation of Section 1.2 above.<\/p>

5.4. BLT FeWo GmbH must immediately notify the guest in writing of the exercise of his or her right of withdrawal.<\/p>

5.5. A justified cancellation by BLT FeWo GmbH does not entitle the guest to claim damages.<\/p>

6. Check-in, handover, and check-out of the vacation rental<\/p>

6.1. The guest has no right to be assigned a specific vacation rental unless this has been expressly agreed upon in writing. BLT FeWo GmbH will endeavor, to the extent possible, to accommodate the guest\u2019s preferences regarding the location of the accommodations. <\/p>

6.2. Reserved vacation rentals are available to guests starting at 4:30 p.m. on the agreed-upon arrival date. Guests are not entitled to earlier access. <\/p>

6.3. On the agreed departure date, the vacation apartments must be vacated by 9:30 a.m. at the latest and left in a clean and tidy condition. Thereafter, due to the delayed vacating of the vacation rental, BLT FeWo GmbH may charge 50% of the full accommodation rate (list price) for its use beyond the contractual period until 6:00 p.m., and 90% after 6:00 p.m. This does not give rise to any contractual claims on the part of the guest. The guest is free to prove that BLT FeWo GmbH has incurred no claim for usage fees or a significantly lower claim. <\/p>

6.4. BLT FeWo GmbH rents out furnished residential units. The rooms and furnishings must be treated with care.\u2028 \u2028<\/p>

7. Liability of BLT FeWo GmbH<\/p>

7.1. BLT FeWo GmbH\u2019s liability for breaches of contractual obligations and for torts is limited to cases of willful misconduct and gross negligence. This does not apply to injuries to life, body, or health. Furthermore, liability remains unaffected for breaches of obligations whose fulfillment is essential for the proper performance of the contract and on whose compliance the customer may reasonably rely. <\/p>

7.2. BLT FeWo GmbH is liable to the guest for items brought into the property in accordance with statutory provisions, i.e., up to one hundred times the accommodation price, but not exceeding \u20ac2,000. For valuables (jewelry, etc.), this liability is limited to \u20ac500. We recommend using the safe. Liability for cash is excluded. <\/p>

7.3. If a parking space is made available to a guest on the property\u2014even for a fee\u2014this does not constitute a contract of safekeeping. BLT FeWo GmbH has no obligation to monitor the property. BLT FeWo GmbH is not liable for the loss of or damage to motor vehicles parked or maneuvered on the property of the vacation rental or their contents, unless BLT FeWo GmbH, its legal representatives, or its agents are responsible for such loss or damage due to willful misconduct or gross negligence. Any damage must be reported to BLT FeWo GmbH immediately, at the latest upon leaving the vacation rental property. The same applies to (electric) bicycles. <\/p>

9. Final Provisions<\/p>

9.1. Any amendments or additions to the contract, the acceptance of the application, or these General Terms and Conditions must be made in writing. Unilateral amendments or additions made by the customer are invalid. <\/p>

9.2. The place of performance and payment, as well as the exclusive venue\u2014including for disputes involving checks and bills of exchange\u2014in commercial transactions is Borkum. If a contracting party meets the requirements of Section 38(2) of the German Code of Civil Procedure (ZPO) and has no general place of jurisdiction within Germany, Borkum shall be the place of jurisdiction. <\/p>

9.3. German law applies. The application of the UN Convention on Contracts for the International Sale of Goods and conflict-of-laws provisions is excluded. <\/p>

9.4. If any provision of these General Terms and Conditions is or becomes invalid or void, this shall not affect the validity of the remaining provisions. In all other respects, the statutory provisions shall apply. <\/p>

9.5. The printed final prices are in euros (\u20ac) for the respective length of stay and are valid until further notice.\u2028 \u2028As of 11\/2025 \u2013 Subject to change\u2028<\/p>
